By accessing or using PlayHT's services, website, or application (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you may not access or use the Service.
These Terms apply to all visitors, users, and others who access or use the Service. By using the Service, you represent that you are at least 18 years of age, or if you are under 18, that you have obtained parental or guardian consent to use the Service.
We reserve the right to update or modify these Terms at any time without prior notice. Your continued use of the Service after any changes constitutes your acceptance of the new Terms. We encourage you to review these Terms periodically.
2 Account Terms
To access certain features of the Service, you must register for an account. When you register, you agree to provide accurate, current, and complete information and to keep this information up to date.
- You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
- You must immediately notify PlayHT of any unauthorized use of your account or any other breach of security.
- PlayHT will not be liable for any loss or damage arising from your failure to comply with this section.
- You may not use another person's account without permission.
- One person or entity may not maintain more than one free account.
You may delete your account at any time by contacting support or through your account settings. Upon deletion, your data will be removed in accordance with our Privacy Policy.
3 Acceptable Use
You agree not to use the Service for any unlawful purpose or in any way that could damage, disable, overburden, or impair the Service. Prohibited activities include, but are not limited to:
- Creating content that is defamatory, obscene, abusive, or constitutes hate speech.
- Impersonating any person or entity, or misrepresenting your affiliation with a person or entity.
- Using voice cloning to create deepfakes or to impersonate individuals without their explicit consent.
- Generating content for fraudulent, deceptive, or misleading purposes, including scams and phishing.
- Violating any applicable laws, regulations, or third-party rights.
- Attempting to reverse-engineer, decompile, or disassemble any part of the Service.
- Using automated means to access the Service beyond what is permitted by our API terms.
4 Intellectual Property
The Service and its original content (excluding content provided by users), features, and functionality are and will remain the exclusive property of PlayHT, Inc. and its licensors. The Service is protected by copyright, trademark, and other laws.
Your Content: You retain ownership of any text or input you provide to the Service. By submitting content, you grant PlayHT a non-exclusive, worldwide, royalty-free license to use, process, and transform your content solely for the purpose of providing the Service to you.
Generated Audio: For paid plan subscribers, you own the audio output generated by the Service from your text input, subject to the terms of your subscription plan. Free plan audio outputs include a PlayHT watermark and may not be used for commercial purposes without upgrading to a paid plan.
Voice Models: PlayHT's pre-built voice models remain the intellectual property of PlayHT. Custom voice clones created using your own voice recordings are licensed for your use under your subscription plan.
5 Payment Terms
Certain features of the Service require payment of fees. You agree to pay all fees associated with your selected plan. Fees are non-refundable except as expressly stated in our Refund Policy.
- Subscription fees are billed in advance on a monthly or annual basis, depending on your selected billing cycle.
- All fees are stated in United States Dollars (USD) unless otherwise indicated.
- PlayHT reserves the right to change pricing at any time, with 30 days' notice to existing subscribers.
- If your payment method fails, we will attempt to charge it again. After repeated failures, your account may be downgraded to the Free plan.
- You are responsible for any applicable taxes related to your use of the Service.
6 API Usage
Access to the PlayHT API is available on eligible plans. Your use of the API is subject to these Terms as well as any additional API-specific documentation and rate limits.
- API keys are confidential. You must not share your API keys or embed them in client-side code.
- Rate limits apply based on your subscription plan. Exceeding rate limits may result in temporary throttling or suspension.
- You may not use the API to build a competing service or to resell API access without a separate agreement.
- PlayHT may update or deprecate API endpoints with reasonable notice.
7 Disclaimers
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
PlayHT does not warrant that the Service will be uninterrupted, timely, secure, or error-free, or that the results obtained from the use of the Service will be accurate or reliable. The quality and accuracy of generated audio may vary depending on input text, selected voice models, and other factors.
8 Limitation of Liability
IN NO EVENT SHALL PLAYHT, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
PlayHT's total aggregate liability to you for all claims arising out of or relating to the use of the Service shall not exceed the greater of (a) the amount you paid to PlayHT during the twelve (12) months preceding the claim, or (b) one hundred dollars ($100).
9 Termination
We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including but not limited to a breach of these Terms.
Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may do so through your account settings or by contacting support.
All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
10 Governing Law
These Terms shall be governed and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
Any disputes arising out of or in connection with these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall be conducted in Wilmington, Delaware.
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
